The Council of State dismissed on Wednesday the unions that wanted to seize the Constitutional Council on the latest unemployment insurance reform that introduced the principle of a modulation of the compensation rules according to the economic situation.
As of February 1, the length of compensation for all job seekers eligible for unemployment insurance has been reduced by 25%. This period may increase if the unemployment rate exceeds 9% or after a sudden deterioration in the labor market.
A modulation “directly related to the object of the law that establishes it”
Plusieurs syndicats (CFDT, CGT, CFTC, CFE-CGC, Unsa, Solidaires et FSU) avaient soulevé une “question prioritaire de constitutionnalité” mais le Conseil d’Etat a estimé qu’il n’y avait pas lieu de la renvoyer devant le Constitutional Council. The Council of State considers that the modulation of the payment conditions of the insurance benefit depending on the economic situation “cannot undermine, by itself, the existence of a compensation system for workers deprived of employment”, according to its estimates the unions in their applications.
In addition, this modulation “is directly related to the purpose of the law that establishes it, which is to ensure compensation for workers involuntarily deprived of their employment while favoring the resumption of a professional activity,” he adds.
