Macronista deputy Marc Ferracci has presented a bill to fight discrimination in hiring based on the origin of candidates, “systematizing” “statistical and individual tests” thanks to a dedicated service. Close to Emmanuel Macron, Marc Ferracci (Renaissance) announced several months ago that he was working on this “test” issue. Registered with the National Assembly on Tuesday, his bill is signed by his entire group and he hopes to review it in the fall. The deputy assures that the calendar is not related to the riots in the working-class neighborhoods, after the death of the young Nahel in Nanterre.
Its text provides for the creation of a specific service, attached to Matignon, responsible for “systematizing” these “evidences of discrimination”. It would have “the mission of helping citizens who request it to carry out individual tests.” This may consist of submitting the CV of a real person, along with a comparable CV under another name, in order to identify potential discrimination and take legal action.
Publication of the names of the structures that have a discriminatory behavior
The service “would also be in charge of carrying out statistical tests on companies and public bodies”, with the massive sending of false CVs, differentiated only by a chosen discrimination criterion (the origin of the person, for example). Used by researchers, this technique makes it possible to observe differences in the responses of employers.
The text intends to “give a legislative basis for the dissemination of the results of the statistical tests” and the publication of the names of the structures “whose discriminatory behavior has been established”. In order to avoid the publication of the results, interested employers would have the possibility, in a limited time, to implement a plan to combat discrimination.
Marc Ferracci indicates that discrimination tests are “clearly distinguished” from ethnic statistics that are banned in France, “since they are in no way based on the systematic collection of individual data.” Visiting Marseille at the end of June, Emmanuel Macron had promised a “systematization” of “trials” and “additional means”.
