The National Assembly validated on Friday a new principle of suspension of RSA rights in case of non-compliance, with the beneficiary being able to recover at least part of the lost sum, a more gradual punishment affirms the executive, a “shame” denounces the LEFT.
During the examination of the “full employment” bill, the deputies adopted an article that establishes this “suspension-remobilization”, as the presidential side calls it.
If a beneficiary does not sign a “reciprocal commitment contract” or does not respect part of his obligations, the departmental council – or France Travail if the department delegates this authority – may decide to suspend payment of his RSA.
However, if the beneficiary complies with his obligations, he may retroactively recover the lost sums. But he was only able to recover a maximum of three months’ worth of RSA payments, a limit added against the Government’s advice during the bill’s consideration in the Senate, but which he eventually accepted.
An article of “shame” for the left
Currently there is already a sanction “which consists of amputating the RSA of a home”, but in practice “this part is never returned”, stated the Minister of Labor, Olivier Dussopt, defending the new system as a more gradual sanction than the suspension without retroactivity. payment or withdrawal pure and simple.
Far from being convinced, the left criticized at length a “shame” article that, by establishing a new type of sanction, would end up increasing the number.
“At the center of their project is not support, but rather the toughening of the threat and sanction,” criticized the communist Pierre Dharréville.
“Everything shows that the sanction leads to the street and the exit of the system, it is a fact,” insisted socialist deputy Arthur Delaporte.
For the president of the LFI group, Mathilde Panot, the measure goes against the International Convention on the Rights of the Child, which establishes that the signatory States must protect the child “against all forms of discrimination or sanction motivated by the legal situation (or ) the activities (…) of their parents”.
“There are people who cannot attend a Pôle emploi appointment because they cannot afford the train ticket,” criticized Jocelyn Dessigny (RN).
The article was approved by 38 votes to 30 with the support of the majority and the LR. The left and the Liot group voted against. The RN abstained.
