Suez urgently went to the administrative court of Paris to challenge the reactivation of the tender for the large water market of Ile-de-France (Sedif), affected in the spring by a computer error, a source close to the matter learned on Friday.
Through this “pre-contractual summary”, Suez denounces the non-application of the provisions of the public procurement code, in order to block the decision of the Ile-de-France Water Union (Sedif) to continue with the appeal of offers for this A huge market of 4.3 billion euros in 12 years, according to this source, confirming Marianne’s information.
continue the process
The process had been suspended since an incident occurred in April on Sedif’s IT platform, which caused confidential documents destined for Suez to land on its rival Veolia. After six months of uncertainty, Sedif, chaired since 1983 by André Santini, decided in October to continue the process, based on the offers received before the incident.
The union explained this decision by virtue of a precedent that occurred at Transdev in 2017: the transport operator mistakenly had in its hands a USB memory containing the proposal of its competitor Keolis. Lille, the market’s awarding authority, ultimately made its decision based on the proposals as they stood on the eve of the incident.
But in the case of Sedif, “the price has not yet been negotiated” and “nothing guarantees that users will be able to benefit from an attractive rate,” explains Marianne. The hearing before the administrative court will take place on November 21.
