“No one knows where the craftsman is”: how a RIB error left a couple out of work

The couple from Charente-Maritime had to pay a bill of 176,000 euros to the builder of their house. But the latter never received the payment due to an error by RIB.

There were only 4 days left until the official delivery of the keys to the accommodation. On March 1, 2021, a young couple received an email from the builder of their house in La Jarne (Charente Maritime). The company Maisons d’en France demands payment of a final invoice of 176,509 euros from a shared inflatable boat as an embargo.

Problem: the bank details are not correct and are those of Tim Bat, a craftsman who works for the same manufacturer, reports France Bleu. The transfer is made and the artisan is quickly ordered to refund the money transmitted in error. In total 106,000 euros will be returned but more than 70,000 euros are still missing.

Chain of bad news

“No one knows where this craftsman is. He has not paid everything he owes to his lawyer. We only know that his company moved to Paris and that a co-director took over,” explains Florian, the husband of this aggrieved couple. to Blue France.

What follows is a chain of legal proceedings that leaves Florian and Émilie with a huge debt on their hands. The Vendée Housing Cooperative, owner, among others, of the Maisons d’en France agency, wins its case for the damage caused and the judicial court of La Rochelle sentences the couple on May 14, 2024 to pay the sum owed. The pair are asked to turn against craftsman Tim Bat to pay their debt.

And if that were not enough: on October 9, a bailiff showed up at their home to inform them of a period of one month before starting a procedure to seize their assets.

Florian, a technician, and Émilie, a medical secretary who works remotely, want to appeal by paying their legal costs through a prize pool they launched online. “We have already spent almost 4,500 euros in court fees in the first instance. We will still have to spend 7,500 euros. It starts to be a lot when we haven’t done anything,” Florian laments.
