The Council of State, contacted by two unions, confirmed on Friday, October 17, the legality of the framework letter that asked the social partners to negotiate a new agreement on unemployment insurance, thus allowing the Government to relaunch this negotiation.
The highest administrative court ruled that the Bayrou government’s framework document “has the character of a preparatory act and does not constitute, in itself, a decision susceptible to appeal for abuse of power,” according to its decision. The Government of François Bayrou sought to reduce the duration of compensation, in particular by reducing the affiliation reference period (PRA), and to extend the working time necessary to qualify for unemployment benefits.
The Council of State was contacted by the CFDT and Force Ouvrière, who were opposed to the opening of new negotiations on compensation rules for job seekers. “The 2018 law”, which obliges the social partners to negotiate within the framework defined by the Government, “does not allow everything and, in particular, the use of unemployment insurance as a budget adjustment variable”, estimated Olivier Guivarch, national secretary of the CFDT.
