Faced with the risk of load shedding, companies must take measures against their staff. The exceptional implementation of teleworking on cut-off days could be considered for companies where this is possible. For others, partial activity can be activated as in the time of confinement.
In fact, power outages are considered an exceptional reason for resorting to partial unemployment, within the framework of the economic and social resilience plan drawn up in early January to deal with the consequences of the war in Ukraine.
Terms
Be careful though, the government has just specified the framework and conditions. The device cannot be used:
- that if the company directly affected by the load shedding is not capable of organizing the working time of its employees;
- only as a last resort;
- and only for the duration of the load disconnection and, where appropriate, for the time necessary to restart the production units.
It should be remembered that these load shedding can be done in 2-hour increments in the morning between 8 a.m. and 1 p.m. and at night between 6 p.m. and 8 p.m.
Nothing planned at the moment in case of school closures
“Since it is a partial activity due to exceptional circumstances, the request for partial activity does not have to be prior and can be made within 30 days of the placement in partial activity” specifies Anne-Lise Castell, Legal expert in social law and editor at Tissot Editions.
The partial activity allows the beneficiary worker to receive compensation equivalent to 60% of his previous gross salary, with a limit of 60% of 4.5 SMIC. The company, for its part, receives a partial activity subsidy equivalent to 36% of the previous gross salary of the employees, with a limit of 36% of 4.5 SMIC, with a floor of 7.88 euros.
If the partial activity covers the closure of a company due to loosening of cargo, nothing has been specified in the case of workers forced to keep children at home in the event of school closure. During the lockdowns, the system covered this problem.
