Restaurants and bakeries at the top of collective processes, according to commercial courts

Combining all sectors, there were 37,468 collective procedures in France last year, an increase of 52% in one year, but this is 15% less than in 2019, before the health crisis.

Restaurants and bakeries are the activities for which collective processes (liquidations, receiverships, safeguards) have increased the most in 2022, according to a report published this Tuesday by the records of the commercial courts.

The increase compared to 2021 in these procedures is 119.8% for traditional restaurants, 117.6% for bakeries and bakeries-pastry shops, and 112.3% for fast food, according to the National Business Report for 2022 published by the National Council of Registrars with the Specific Institute Xerfi.

“Bakery and pastry is the sector with the highest rate of bankruptcy, with 2.5% of the total companies” in this sector affected, explained Laurent Frelat, vice president of Xerfi Specific, during a presentation to the press.

In almost four out of five cases, the judicial processes are direct liquidations, which result in the disappearance of the company.

First quarter of 2023 wrong

“The very high energy costs especially affect activities such as bakery-pastry, catering (traditional, fast), small transport structures or local services (hairdressing, clothing, repairs, etc.)”, the study notes.

Thanks in particular to government assistance, the number of company bankruptcies and lawsuits before commercial courts had reached a historically low level during the health crisis.

The administrators and the Xerfi institute today expect “a first semester of 2023 that is still poorly oriented”, with a sharp increase in procedures, although their increase fell in the fourth quarter of a year (+49%) compared to the third (+72, 7%).

According to the balance, the number of registrations in the Commercial and Company Register (RCS) decreased last year by 6.2% compared to 2021, falling to 573,132 (excluding Alsace-Moselle, where there are no commercial courts), despite the fact that the total number of business creations, which includes the self-employed not registered in the RCS, reached the historical record of 1,072 million in 2022, according to INSEE.

Finally, the penalties of companies increased last year by 11.6%, or 346,511 companies punished by the commercial courts. Of ten new companies in the RCS, six have been terminated.
