The Constitutional Council partially censored this Friday the text of the pension reform law, having rejected the nine “wise” six provisions, including the senior index and the senior indefinite contract (CDI), but validated the postponement at 64 year old. the age of onset.
The censored provisions were deemed unconstitutional because they had no connection to the Social Security Funding Reform Bill (PLFSS) which includes pension reform. The emblematic measure of the text on the postponement of the legal retirement age from 62 to 64 years has been validated by the “wise men”.
The 6 rejected provisions:
- Section 2, relative to senior index
- Section 3, relating to the employment contract of senior managers
- article 6, which introduced certain modifications in the organization of the rcollection of social security contributions
- Certain provisions of Article 10 relating to Conditions for granting the right to early departure of civil servants having provided their services in a job classified as active or superactive during the ten years prior to their exercise,
- Certain provisions of article 17 relating to specific individual monitoring for the benefit of workers who carry out or have carried out trades or activities that are especially exposed to certain occupational risk factors,
- Article 27, which establishes an information system for policyholders in the pay-as-you-go pension system.
