PMA Post-Mortem: A CAENNAISE obtains a favorable decision of the European Court of Human Rights

This Monday, September 8, he won a first victory in the European Court of Human Rights.

A “surprise” victory

The highest European jurisdiction announced Charlotte Ngoma that he agreed to seize his request. The 38 -year -old Caennaise had brought her archive against them in front of the legal obstacles she faces within the framework of her project: the Public Health Code requires that both parents are alive to begin the process.

This decision occurs after months of combat. Thirty had already been dismissed by the Administrative Court of CAEN, then by the State Council.

“I am very happy, I am very surprised, I had gone down a bit. After so many failures, I was desperate,” he told Normandy here.

Charlotte Ngoma and her husband had launched her PMA career in 2022. Three embryos had been frozen and confident at the center of the Caen hospital, which undertakes to keep them until the end of the legal procedures.

“Small opportunities” for an agreement with the State

After a long confrontation against the French State, the CAENNAise had decided to request the European Court of Human Rights, who considered its last appeal. This favorable response could alter the law in France in this type of file.

Initially, negotiations must now be carried out to find a friendly solution between the two parties. They will end on November 28. In case of persistent disagreement, the file will open in front of the court.

Charlotte Ngoma predicts that there are “few possibilities” to reach an agreement with the State. Trust our Normandy colleagues hope that the court “condemn France for violation of my rights.”
