The Council of State refused, this Tuesday, October 14, to rule on the temporary ban on the practice of medicine imposed on Professor Didier Raoult, BFMTV learned by order of the doctors, confirming information from the specialized press agency APM News.
The fourth chamber of the contentious section of the Council of State decided to dismiss the appeal of the Marseille microbiologist.
Didier Raoult was sanctioned with a reprimand by the national disciplinary chamber of the doctors’ order in December 2021. He is accused of having violated several articles of the public health code, in particular by promoting a treatment based on hydroxychloroquine against Covid-19, without reliable scientific data.
After more than four years of controversy, the founding study of the IHU of Marseille on the use of this substance in the epidemic contextsigned in particular by Didier Raoult, was officially invalidated in December 2024.
A sanction that is too “lenient” in the first instance
The medical order appealed this reprimand as it was considered too “lenient.” In October 2024, the Marseille professor was banned from practicing medicine for two years from February 1, 2025.
He tried in vain to take his case to the highest French administrative court. This appeal was not suspensive and he has already served eight months of sanction.
The professor took advantage of this period to invest in other projects, in particular the co-founding of a cosmetics start-up that offers products with “anti-aging” properties for sale.
The Marseille prosecutor’s office is also investigating suspicions of unauthorized clinical trials.
