This Wednesday, the PS rejected IL’s request to appoint the rapporteur for an opinion to monitor the dismissal process of the Supervisory Board of the Information System of the Portuguese Republic (CFSIRP).
Last week, IL had asked the Committee on Constitutional Affairs, Rights, Freedoms and Guarantees to appoint a rapporteur to prepare an opinion on whether or not to dismiss the members of the Supervisory Board of the “secretas”, after their hearing in parliament.
This request was rejected on Wednesday, with the PS voting against, the PCP abstaining and the PSD and IL voting in favour.
This proposal came after a debate at last Wednesday’s committee meeting over whether the CFSIRP’s dismissal process had already begun with the approval of another application by the Liberals and the subsequent hearing of CFSIRP members.
On that day, PSD and IL argued that the process had already started as the steps provided for in the law had been followed and no rapporteur had been appointed to prepare the opinion, while PS and Chega considered that this was not the case used to be.
The SIRP Framework Law of 1984 stipulates that “the Assembly of the Republic is responsible for verifying the impediments, as well as for deciding on the dismissal, after an opinion of the competent committee for constitutional affairs, rights, freedoms and guarantees after the hearing of the member, by a two-thirds majority of the alternates present, not less than an absolute majority of the alternates in office”.
This discussion continued this Wednesday, with the President of the 1st Commission, Fernando Negrão, pointing out that “the process was closed and the request now submitted by IL has reopened it”. or “the rapporteur should be appointed so that the members of the Supervisory Board can be changed”.
“I looked at the deputy sheriff and asked her whether the trial was there or not, and the answer was that it had not been clarified and the fact that it had not been clarified led to the conclusion that she would not present it, or she would it has not yet submitted the request for the appointment of a rapporteur,” the social democrat added, also recalling that last week another request from Chega to start the CFSIRP’s dismissal process was rejected.
In response, deputy Patrícia Gilvaz said IL indicated it had not been clarified and that the firing process “should continue”, with the appointment of the rapporteur to draft the opinion that would be voted on later.
“The president never asked if the IL wanted to end the trial there”, he claimed, as Fernando Negrão “should have made it very clear what process to follow” as it has no precedent and “it’s not clearly written anywhere”.
The chairman of the Committee on Constitutional Affairs, Rights, Freedoms and Guarantees then stressed that the deputy “has a duty to know and interpret the law”, insisting that it is not her duty “to teach the deputies how to interpret”. of the legislation.
Deputy Pedro Anastácio, from the PS, reiterated that “at no point did the PS consider that this procedure had been initiated” and he understood that the hearing that took place was “a preliminary hearing to” initiate the eventual dismissal procedure, and defended that it was up to IL to “clarify exactly the purpose of its request”.
For PSD, Deputy Mónica Quintela pointed out what she considered to be the difference between the two requests, stating that Chega would “start proceedings”, while IL’s “wanted to give continuity to what had” begun.
IL accuses PS of “abuse of the absolute majority”
The IL accused the PS of “abuse of the absolute majority” for rejecting the Liberal request for the appointment of the rapporteur of an opinion aimed at continuing the dismissal process of the Secrets Inspection Council.
“The PS abuses what is the absolute majority with delaying maneuvers in order not to reach the end of this procedure and here the question arises: why does the PS not want to bring this procedure to an end and, ultimately, if it does not agree with it , voted against?”argued the IL’s parliamentary leader, Rodrigo Saraiva.
The Liberal deputy spoke to journalists in parliament after the Socialists rejected an IL request for the appointment of the rapporteur for an opinion on the dismissal process of the Supervisory Board of the Information System of the Portuguese Republic (CFSIRP).
Rodrigo Saraiva cited the request submitted by IL in May, in which the parliamentary group urged “to hear the members of the supervisory board of the information system of the Portuguese Republic, for the application of numbers 6 and 7 of Article 8.º, of Law No. 30/84”, a hearing that took place on 21 June behind closed doors.
“These are the articles that refer to exactly what is the dismissal of the Supervisory Board of the Information System of the Republic. And the law says that this is done with a hearing, with an opinion on that hearing, and then the opinion is voted on “, he said. said.
If later the opinion “was adopted or not, it is a matter of no consequence”, continued Rodrigo Saraiva, who criticized the PS for insisting that the request “was not obvious” in relation to this procedure, with ” the knowledge of the President of the Commission of Constitutional Affairs, the Social Democrat Fernando Negrão.
The Liberal stressed that the understanding of the committee chairman is different from “his own group”.
“We can’t help but show our displeasure here with yet another whitewash that the PS wants to do to what was the lack of impetus that the ‘secret’ Supervisory Board had, not only in the April 26 episodes at the Ministry of Infrastructure, and in laundering that the Supervisory Board was already doing what was the action of the intelligence services that night, but also during his mandate – but these are issues that were dealt with behind closed doors that I cannot specify here, for the law,” he added.
