PR establishes a degree that changes the status of administrative and tax courts

The President of the Republic, Marcelo Rebelo de Sousa, issued the diploma introducing changes to the Statute of the Administrative and Tax Courts and to the Code of Tax Procedures and Procedures, noting that he did not accept “suggestions” from the Supreme Court .

“Although he did not accept the suggestions of the Supreme Council of Administrative and Fiscal Courts, taking into account the innovations introduced, the President of the Republic promulgated the diploma that the Statute of Administrative and Fiscal Courts, the Code of Tax Procedures and Processes and the regime changes. of the elements of the implementation process of the solidarity and social security systemreads the note published today on the website of the Presidency of the Republic.

The government approved this decree-law in the Council of Ministers on Thursday, which, he explained, aims to increase the capacity and speed of justice in these areas.

According to the government, “the impact of these changes contributes directly to the achievement of the objective of increasing the responsiveness of the administrative and tax jurisdiction, making it more efficient, faster and more transparent”.

In the note, the executive emphasized that “the planned promotion of the specialization of the courts, in particular with regard to the creation of new subdivisions, also corresponds to one of the reforms envisaged in the Recovery and Resilience Plan [PRR]”.

The draft law, published on the ‘website’ of the Assembly of the Republic, explains that “despite the measures taken by the legislature in recent years, the administrative and fiscal jurisdiction continues to face serious challenges and limitations that often prevent it within a reasonable period of time, disputes submitted to it by citizens, companies and governments”.

According to this proposal, it is “fundamental to strengthen the responsiveness of administrative and tax courts and to optimize their functioning, through a series of changes of surgical scope, for the structuring of degrees of this jurisdiction”.

So “to accompany the increasing technical-legal complexity of certain disputes”, it is enshrined “in Article 32 of the ETAF [Estatuto dos Tribunais Administrativos e Fiscais]the establishment of specialized subdivisions in the Central Administrative Courts”, among other measures.
