The mayor of the city of Chartres (Eure-et-Loir), Jean-Pierre Gorges, is the subject of a complaint for “illegal taking of interests”, reports Thursday France 3 Centre-Val de Loire. According to his information, the complaint was filed by four elected opposition environmentalists and more than a dozen citizens in April 2021.
The elected Les Républicains is accused of having voted on certain decisions during the municipal councils as judge and party.
Deliberations for “functional protection” votes
The prize for the interest of nature is fair, it is for a person who invests in a public elective mandate, “to learn, receive or conserve, directly or indirectly, an interest of nature to commit to impartiality, independence or objectivity dans une entreprise ou dans une opération dont elle a, au moment de l’acte, en tout ou partie, la charge d’assurer la surveillance, l’administration, la liquidation ou le paiement”, explain l’article 432-12 du Penal Code.
This crime is punishable by five years in prison and a fine of 500,000 euros.
In the case of Jean-Pierre Gorges, the complaint refers to three deliberations regarding voting for “functional protection”, explains France 3. It is a measure “of protection and assistance due by the administration to any agent who is the victim of a crime in the exercise of their functions or by reason of their functions”, writes the Public Service website.
The complaint explains, for example, that on December 10, 2020, the mayor claimed this protection after filing a defamation complaint against the local satirical newspaper cactus press. He participated in the vote that granted him this protection or not, while he was judge and party, it is in this sense that the illegal taking of interests is characterized for the plaintiffs.
Jean-Pierre Gorges declined to comment on this complaint to France 3.
