The Constitutional Court rejects AR’s solution for metadata

This Monday, the Constitutional Court (TC) failed in the solution proposed by Parliament to remedy the shortcomings in the Metadata Act.

The decision was announced by the court.

This concerns access to electronic communications by authorities when necessary in the context of criminal investigations.

The President of the Republic, Marcelo Rebelo de Sousa, had sent the diploma for preventive inspection in early November.

When he sent the text to the TC, the president spoke of “reasons of legal certainty”. “For reasons of legal certainty, the President of the Republic has decided to subject the decree of the Assembly of the Republic, which regulates access to metadata, to a preventive constitutionality inspection. referring to electronic communications for the purpose of criminal investigations, in accordance with the attached request addressed to the Constitutional Court”, read the note published on place of the presidency. Days before, the head of state had already said that there could be no doubt about its constitutionality.

The decree was approved in parliament in a final vote on October 13, with positive votes from PS, PSD and Chega. IL, PCP, BE and Livre voted against.
