The Constitutional Court rejects the third request for registration of the Nova Direita movement as a political party

The Constitutional Court (TC) has rejected the application for registration as a political party of Ossanda Liber’s ‘New Right’ movement, finding that the draft statutes do not meet legal requirements.

The TC “Considers that there is no need to verify the legality of the draft statutes and decides to reject the application for registration, in the Court’s own register, of the political party called “NOVA DIREITA” and the acronym ND’, states a ruling dated December 13, published on the court’s website.

This movement, chaired by Ossanda Liber (who was vice-president of the Aliança party), had already requested registration as a political party twice this year, but the TC refused due to a lack of subscribers (minimum 7,500 signatures) or because they detected signatures invalid.

Among other aspects that conflict with the Law on Political Parties, the TC points out in this third request that the presented draft statutes do not guarantee the independence and impartiality of the judiciary when assessing decisions to punish activists.

The lack of a specific deadline for making decisions by the courts was also highlighted by the TC.

In the ruling, the judges also point out an omission in the draft statutes, warning that the law requires that party statutes must contain standards that expressly guarantee the balanced participation of women and men in political activities and non-discrimination on the grounds of gender in society to guarantee. access to internal agencies and applications.

Ossanda Liber also believes that this decision of the TC “represents a significant setback for Nova Direita, which seeks to represent a new political vision and defend the conservative values ​​and principles it considers essential for the country”.
