PS with constitutional revision project to expand “fundamental rights”.

The PS will present a constitutional revision project to consolidate and expand “fundamental rights” in addition to the issues already analyzed with the PSD on health emergency law and access to metadata in criminal investigations.

Members of the socialist leadership told Lusa that internal work on the constitutional revision started “some time ago” and that the basic principles of the future project will be presented this Thursday at the meeting of the PS National Political Commission.

“We will not go down the path of a surgical constitutional revision, limited to one or two issues. There is a way to have a more progressive constitution of the Republic, which consolidates and expands the catalog of fundamental rights, especially in the social field” , declared a leader of the PS.

From a political point of view, the constitutional revision project aims to draw “a clear dividing line” with regard to Chega, the party that initiated this process in the Assembly of the Republic, “but it also poses a challenge with regard to the PSD”.

In institutional matters, the PS project should not contain any amendments, although issues related to regional autonomy have been identified during the internal discussion work, but are not going any further for the time being.

In addition to issues related to fundamental rights, the PS will, as expected, include in its project the issue of access to electronic communication data – the so-called metadata – by security forces in criminal investigation processes and the basic health emergency law.

These two topics were the subject of a general discussion between the Prime Minister, António Costa, and the PSD President, Luís Montenegro.

Regarding the metadata, the PS and PSD twice approved projects in the Assembly of the Republic to increase the investigative resources of police and security forces, but twice their diplomas were rejected by the Constitutional Court.

As for the health emergency law, the waves of covid-19 between 2020 and 2021, according to the socialists, have made it possible to detect the limitation of the current constitutional text with regard to enabling a greater range of emergency measures in pandemic situations.

Also according to socialist sources, the coordination process of the constitutional revision project was handed over to the party president, Carlos César, to the general secretary of the PS, to its deputy general secretary, João Torres, and to the parliamentary leader, Eurico Brilhante. To dawn.
