PCP wants to lay down a minimum subsistence level for all citizens in the Constitution

The PCP wants to enshrine in the constitution a minimum subsistence for all citizens and determine the valuation “in real terms” of the national minimum wage, and also proposes a gradual reduction of working time, “without loss of rights”.

In the constitutional revision project presented by the PCP, which was submitted to the Assembly of the Republic last Friday, the communists defend the “constitutionalization of a minimum subsistence for all citizens”.

Without specifying values, the PCP therefore proposes an amendment to Article 63 of the Constitution, on “Social Security and Solidarity”, introducing a new number to provide that “the law guarantees all citizens a minimum income guarantees”.

In a document that the communists claim aims to “improve and perfect the Constitution”, the PCP also proposes an update to No. 2 of Article 59 of the Fundamental Law, which would provide for “the establishment, updating and appreciation in real terms”. conditions of the national minimum wage (SMN)”, in contrast to the current article, which does not mention the valuation of the SMN.

Similarly, in Article 63 of the Constitution, the PCP proposes to include a new number, which would stipulate that “pensions and reforms must be regularly updated and valued in real terms”.

Still in the field of labor, the communists also want the constitution to stipulate that the limits of working time at the national level be “gradually” reduced, “without loss of rights”.

Among several proposals to amend the Constitution, the PCP also suggests that Article 74 of the Fundamental Act states that “all levels of public education shall be free”. In the same article, the communists also defend the establishment of a “public system of pre-school education, universal and free”.

With regard to the health area, the PCP foresees that number 2 of Article 64 will drop the current wording — which stipulates that the right to health protection is exercised “through a national health service (SNS) universally and generally”, “tendentially free” — , to establish that this right is guaranteed by a “universal, general and free SNS”.

In this project, the PCP criticizes the current process of constitutional revision as it is “not only unnecessary, but also reprehensible for its purpose of undermining the constitutional democratic regime”.

However, the communists say they are not willing to back down “to fully assume their responsibilities and intervene in that process with their own constitutional reform project”.

“The Constitutional Revision Project proposed by the PCP aims not only to defend the Constitution, but also to improve and perfect the Constitution, either by restoring fundamental provisions that have been amended in the meantime, or by moving forward with innovative proposals aimed at enriching the text of the Constitution,” he says in the document.
