The law already establishes that the prosecutor informs the victim of the classification without the continuation of his complaint by indicating the reasons that motivate this decision.
But many testimonies of the victims in recent years, in particular sexist and sexual violence, have pointed out “important dysfunctions,” according to the rapporteur.
The classifications “announced through telephone calls, without being able to retain the classification date, simple letters, recommended letters not received, change of address, sometimes the lapidal, incomprehensible motivations,” he explained to Jiovanny William.
An “essential educational effort”
Therefore, the text aims to “better accompany the victims when their complaint is classified without continuing” then “that we all know how much this moment, when it occurs, can be experienced as a new shock”, in the words of the Minister of Justice Gérald Darmanin in the opening of the debates.
At the time of submitting their complaints, the victims will receive a copy of the minutes, then facilitating their traceability. You can also choose the way you adapt to those notified from the rest of your complaint: registered letter, email or simple mail.
The motivation for the classification decision must “be expressed in simple and accessible terms”, as well as in possible remedies.
“This educational effort is essential to help the victim understand the treatment of their complaint and better accept the judicial decision,” according to the rapporteur.
In addition, the prosecutor will have to pay the proof that the classification notice has been notified to the plaintiff. The left praised a “necessary” text while denouncing the cuts in the budget of the Ministry of Justice.
“If so many complaints are classified, it is first due to the fact that the Prosecutor’s Office is saturated, the survey services overwhelmed and assistance associations for sub -financed victims,” said environmental deputy Emmanuel Duplessy.
The RN abstained, seeing “beautiful words” but “a practice that will be useless,” according to Deputy Sophie-Laurence Roy.
