The bill that paves the way for a modulation of unemployment insurance according to the economic situation was finally approved on Thursday, after a vote in the Senate. The agreement reached with the right allowed the Government to dispense with the 49.3 weapon.
But the parliamentary groups of La France insumise, the Socialist Party, the Ecologists and the Democratic and Republican Left (communists and overseas deputies) believe in a press release that “this bill violates the rights and freedoms guaranteed by the Constitution, in particular to the principles of fraternity”.

According to the New Ecological and Social Popular Union (Nupes), “the possibility granted to the government to decide by decree the rules of unemployment insurance, without restrictions and bypassing the social partners, calls into question the right of workers to participate in the determination of their working conditions”.
The fact that the government can modulate according to the situation “deprives the insured of rights for which they have contributed” and “contributes a serious attack to the principle of fraternity by conditioning the best social protection of some by the unemployment insurance system to the involuntary loss of the employment of others”, say the leftist parliamentarians.

They also denounce “the loss of rights of employees with fixed-term or temporary contracts who reject two indefinite contracts”, a measure “disproportionate when the country has only 373,100 vacant jobs for 6.16 million registered in Pôle emploi”.
These groups thus ask the Constitutional Council to censor five of the articles of the law.
The consultation with the social partners is underway with a view to applying the modulation at the beginning of 2023, and the Government will announce “the adopted arbitrations” on Monday.
