Dupomb Law: The Constitutional Council censures the reintroduction of a neonicotinoid

For the leftist parliamentarians, who had seized wise men, the text is contrary to the Environment Charter, with constitutional value. In particular, its precautionary principle, as well as the “right to live in a balanced and healthy environment.”

“Reservations” in Megapasinos

In their decision, the wise remember that neonicotinoids “have implications for biodiversity, especially for insects and pollinating birds” and “induce risks to human health.”

In 2020, they had made a temporary defeat to their prohibition, confined to the beets sector and seed coating. This time, the Constitutional Council censures the defeat introduced in the law by pointing out that it is not limited in time, nor to a particular sector, and also refers to spray, which presents a high risk of substance dispersion.

Wise men also issued “two reservations” around “provisions that facilitate the establishment of certain water storage work”, that is, the mega-cajones. Dupumb’s law creates “a presumption of great general interest” in Mega-bassines, Artificial basins to store water to meet the needs of agriculture, especially in summer.

The law wants to allow farmers who wish to install a mega-snea no longer have to demonstrate their usefulness. Specifically, each application must be validated, except in very special cases.

Emmanuel Macron will promulgate the law

A few minutes from the announcement of wise men, the Elysée announced that Emmanuel Macron “took a good note of the decision of the Constitutional Council” and “will promulgate the law.” Therefore, the latter will be reduced from the censored article. Emmanuel Macron now has a fortnight to promulgate the law.
