This Thursday, November 24, the National Assembly approved a bill presented by La France insoumise, which enshrines the right to abortion in the Constitution. 337 deputies voted in favor of the text and 32 opposed it.

Renaissance/Nupes Alliance
The approval of this text was possible thanks to an unprecedented alliance under this new mandate, between the deputies of Nupes, of which the LFI is a part, and those of the presidential majority.
However, Renaissance, Emmanuel Macron’s movement, had opposed a similar approach by the Insoumi in 2018. But the US Supreme Court’s decision this summer to end federal abortion rights protections has changed that.
Aurore Bergé, leader of the macronista deputies in the Assembly, has thus presented a bill to include respect for abortion in the Constitution. But her initiative was cut off by the rebel deputies, who took advantage of their parliamentary niche to debate such an initiative in the Palais Bourbon.
A text that guarantees “effectiveness and equal access” to abortion
Faced with a fait accompli, the deputies of the Renaissance joined the initiative of the Insoumis, which led to the adoption of the text on Thursday. However, a Modem amendment removed the notion of “equal access to contraception” from the text.
The adopted text “guarantees the effectiveness and equality of access to the right and the voluntary initiation of pregnancy.” But despite its approval by the deputies, it has little chance of ever being included in the Constitution.
The bill must now be studied by senators, who had rejected a similar text in October. And if the elected members of the upper house change their point of view on the issue, the French would have to express themselves in a referendum to ratify the text.
