And three. After two negative opinions from the Council of State, Marine Le Pen suffered a new setback. The judges ruled this Wednesday, October 15, in a decision that the former presidential candidate could not ask François Bayrou to repeal the provisions that allowed the courts to sentence her in the first instance to a five-year sentence of immediate ineligibility last March.
At the moment, the president of the RN deputies cannot represent herself before the votes of the voters, whether for legislative, municipal, regional, departmental or presidential elections. Specifically, his candidacy in 2027 is therefore impossible at the moment.
A call next January
In her request, the president of the RN deputies attacks the refusal of former Prime Minister François Bayrou, then in office, to repeal the regulatory articles of the electoral code that allow a sentence of ineligibility to be pronounced with immediate execution. Considers that these provisions are contrary to “the freedom of candidacy” and “the freedom of voters.”
“The Council of State rejects this appeal because it did not seek both the repeal of the regulatory provisions and the modification of the law, which exceeds the powers of the Prime Minister who, therefore, could only reject Madame Le Pen’s request,” reads the institution’s statement.
Marine Le Pen appealed the court’s decision in the first instance. The appeal trial is scheduled for early next year.
