Tax inspectors from the Tax and Customs Administration will now have access to data in the Central Register of Effective Beneficiaries (RCBE), according to a proposal to amend the PS to the National Budget 2023 (OE2023) approved on Wednesday.
This measure is part of a proposed amendment to the OE2023 presented by the PS and approved this Wednesday as part of the specialty vote.
In the justification note for this proposed amendment, the PS delegates recall that the AT’s access to the information contained in the RCBE is limited as it is only legally provided and authorized within the scope of the AT’s legal powers in terms of preventing and combating money laundering and financing of terrorism; for the purpose of monitoring compliance with tax obligations by diligence imposed on financial institutions for the purpose of automatically switching financial accounts; or to respond to requests for information received within the scope and instruments to which Portugal is internationally bound.
With this amendment to the General Tax Act, which has now been adopted, RCBE data is now included in the range of situations to which the competent authorities and the tax inspectorate have access to take the necessary steps to determine the tax status of taxpayers.
