The Créteil Criminal Court ruled on Wednesday that the direct summons was “inadmissible” and canceled the prosecution for embezzlement of public funds against the LFI deputy Mathilde Panot, accused by her opponent Together! during the last legislative elections.
The proceedings were deemed inadmissible because the complainant, Philippe Hardouin, failed to pay a deposit to the court, the Créteil prosecutor’s office said.
Philippe Hardouin “has not lost interest in this procedure,” said his lawyer François Voiron. “There was simply a problem executing the transfer that he ordered and it did not leave his bank,” he added, indicating his intention to issue a new direct subpoena.
Direct subpoena allows the victim of a crime or the prosecutor to go directly to a criminal court.
An “illegitimate and abusive” procedure
In this type of procedure there are no investigations carried out by the magistrates. It charges the plaintiffs with collecting evidence, naming suspects, and making a financial deposit with the court before the hearing.
Philippe Hardouin, candidate Together! in the 10th arrondissement of Val-de-Marne against Mathilde Panot, had seized the criminal court by direct summons after the broadcast of the speech on the Facebook account of the city of Ivry-sur-Seine of the LFI candidate, who arrived first in the first round
“The court concluded that the direct summons of the opposing party against Madame Panot in a procedure that we have always considered illegitimate and abusive is inadmissible,” reacted this Wednesday Jade Dousselin, lawyer for Mathilde Panot, elected last June in the second round of the legislative. elections with 67.63% of the votes.
