The president of the republic assured this Monday that he will declare the diploma of professional orders “immediately” after receiving the communication from the Constitutional Court, which he says has given reason to the government and the “majority of parliament” regarding this new legal regulation. regime.
The Constitutional Court (TC) on Monday declared the law amending the regulation of professional orders constitutional, because it found no disrespect for constitutional principles or norms.
Speaking to journalists at the end of a ceremony at the Instituto Superior Técnico, in Lisbon, Marcelo Rebelo de Sousa said his request for preliminary constitutionality inspection was for the same reason as always: “certainty and security”.
“There were 18 or 19 professional orders that understood that the diploma was very unconstitutional, the government understood the opposite, as did the majority of the Assembly of the Republic, nothing like the TC to clarify that”he said.
For the head of state, the TC’s decision “means that it has given the green light to the majority of parliament and the government to carry out the intended intervention in terms of the new regime” of professional orders.
“This means that, upon receipt of the communication from the TC, I will immediately award the diploma”guaranteed.
A note published on February 1 on the Presidency’s website stated that “the President of the Republic, taking into account legal certainty and security, has decided to withdraw the Constitutional Court’s preventive constitutionality review, the Decree of the Assembly of the Republic amending legislation on professional associations and access to certain regulated professions”.
Marcelo Rebelo de Sousa thought that this diploma “raises doubts about the respect of principles such as equality and proportionality, guaranteeing the exercise of certain rights, self-regulation and democratic character of professional associations, all provided for in the Constitution of the Portuguese Republic”.
This decree was approved in a final vote on 22 December, with PS, Iniciativa Liberal and PAN in favour, PSD, Chega and PCP voting against and BE and Livre abstaining.
The final text of the decree, presented by the Commission for Work, Social Security and Inclusion, emerged from PS and PAN bills.
