CDS MEP and President Nuno Melo asked the European Commission to comment on the situation of teacher service time counting in mainland Portugal and in the archipelagos of Madeira and the Azores, which is not happens at the same rate.
Nuno Melo believes that there is a duality of criteria when counting frozen service time. In the case of teachers from the archipelagos, seniority is counted in full, in stages, while mainland teachers are not counted for 6 years, 6 months and 23 days.
“I ask the European Commission, does it not consider that we are dealing with discrimination and a violation of the principle of equality beyond the scope of the possibilities of legal justification for discriminatory treatment, since differences in treatment are only allowed if they are justified by objective reasons?” writes the chairman of the CDS.
Emphasizing that discrimination should only be possible if there is a legal justification for discriminatory treatment and if it is justified by objective reasons, Nuno Melo then asks the European Commission to express its understanding of this situation on the basis of the Treaties of the European Union.
