This Friday, parliament approved the government’s bill on the transposition of the European Union (EU) directive on the protection of personal data. The vote on the document – transposing directives (EU) 2022/211 and (EU) 2022/228 – received the votes of the parliamentary majority of the PS, PSD and Chega. Liberal Initiative, BE, PCP, Livre and PAN abstained.
On Thursday, the deputy minister of foreign affairs and justice believed that the transposition of the European Union’s (EU) data protection directive is essential to “strengthen” the work of EU joint investigation teams in criminal matters.
Jorge Alves spoke in parliament during the plenary debate on the government’s proposal to transpose the European directive on the protection of personal data into national law, imposing the harmonization of all legal acts adopted by the EU in order to “coherent and effective approach”. ” for the protection of personal data, including all data obtained by joint investigation teams.
Under the proposal, personal data lawfully obtained by a joint investigation team may be used for a purpose other than that for which it was collected, provided that the controller is authorized to process it for that purpose.under the law of the European Union and the Member States, and the respective processing is “necessary and proportionate” to its purpose.
The proposal received specific reparations and criticism from deputies Pedro Filipe Soares (BE), Alma Rivera (PCP), Rui Paulo Sousa (Chega), Patrícia Gilvaz (IL), Paula Cardoso (PSD) and Rui Tavares (Livre), but all of them expressed the availability of their parliamentary benches to refine, correct and improve some aspects of the proposal, with some MEPs expressing doubts about the possibility of the diploma being approved before March 14, within the deadline set by the EU to the Portuguese government has given for that purpose.
