The Commission of Inquiry only gives TAP 10 days to send information in substantiated cases

The TAP Commission of Inquiry this Wednesday deemed “manifestly unenforceable” the extension of a further 35 days requested by the airline to send documentation, admit that only a further 10 days will be granted for exceptional and duly justified cases.

The meeting of the parliamentary committee of inquiry TAP included the airline’s request to the Assembly of the Republic for an additional 35 days to forward the information, as the legal deadline of 10 days was “manifestly insufficient”.

The chairman of the committee, the socialist Jorge Seguro Sanches, proposed a resolution to the deputies rejecting this request, a text that was approved with votes in favor of all parties, except the vote against Chega, and now this answer is being sent to TAP sent.

According to the approved text, “the request for an extension of the deadline by a further 35 days” appears to be “manifestly unenforceable and unfounded on a case-by-case and document-by-document basis” in addition to the 10 days granted, not least because the alleged term for the duration of the commission of inquiry is 90 days.

The Commission of Inquiry decided, among other things, to “grant another 10 days in addition to the 10 days provided for by law to comply with the request for documents drawn up, provided that this justification is accepted on a case-by-case basis” by the President.

“TAP must send the requested documents as soon as it collects them in order not to jeopardize the work of the committee and normal operation,” also refers to the document that will be sent to the airline.

The deputies also respond to TAP that “concerns raised by that company regarding privileged or sensitive commercial information, business secrets, or the relationship of information with personal data are properly protected,” stipulating that the company “must only properly process the document send”. categorized according to the information it contains”.

“The Commission of Inquiry will be responsible for taking the necessary and appropriate measures to ensure the classification assigned to the document,” he added.

It is also recalled that the investigative commissions “benefit from the investigative powers of the judicial authorities”.

TAP asked for an additional 35 days to send the requested information to the investigative committee, as 10 days is a “manifestly insufficient” period, according to a request that Lusa accessed on Tuesday.

“The sheer volume of documents concerned by this request implies the localization, consultation and collection of thousands of documents and files, which in many cases will have to be read one by one,” TAP began in a document addressed to the chairman of the parliamentary committee of inquiry. to the political oversight of TAP’s management, Jorge Seguro Sanches, to which Lusa had access.

The airline says 111 requests have been made, “many” of which represent the collection of “hundreds” or even “thousands” of documents from different areas and require the company to verify that they contain confidential information.
