The PSD accused the government of “acting outside the law” for refusing to send the TAP Commission of Inquiry the opinions that gave “legal support” to the CEO’s dismissal for cause, and asked for an emergency meeting for this Wednesday.
Speaking to Lusa, the PSD Coordinator of the TAP Commission of Inquiry, Paulo Moniz, explained that during the March 6 press conference, the party had requested through a request the legal basis referred to by Finance Minister Fernando Medina. , which announced the resignation for good cause of TAP’s CEO”.
Coincidentally, we were surprised, very surprised, in fact surprised that this information was not sent to us, where it is immediately clear that the ministers have not only misled the Portuguese with regard to the published legal certainty of their decision, but came also to the conclusion that the same ministers are acting outside the law,” the social democrat accused.
According to the deputy, it is about the fact that the ministers of finance and infrastructure “hidden documents from the parliamentary committee of inquiry in clear disrespect for the legal regime of parliamentary investigations and for the powers of the Assembly of the Republic itself”.
“This is an unbelievable situation and that is why we are asking for an emergency meeting of the parliamentary inquiry committee to deliberate and take a position on such an unlawful response,” he revealed.
The request requesting this meeting – which the PSD wants to take place before the hearing of the Commission of Inquiry scheduled for this afternoon – quotes the answer received from the ministries of Fernando Medina and João Galamba.
“Resolution of the General Assembly of the Republic No. 7/2023 of February 14 was approved on February 3, 2023 to establish a Commission of Inquiry to conduct political oversight of the management of TAP SGPS and TAP SA. delimited (cf. subparagraphs a) to g) of said resolution) and, as well as the time horizon (period between 2020 and 2022)”, they refer.
According to the same government response, “by extending the above-mentioned purpose of the parliamentary inquiry committee and/or referring to facts beyond the respective constitution, the information required does not fall within the scope” of the legal regime of parliamentary inquiries.
For Paulo Moniz, “it is not for the government to judge the need and opportunity for the documentation” requested by the deputies.
“This is solely the competence of the Parliamentary Commission of Inquiry, the political forces and the elements that integrate it and who understand the need for the documents that can be requested for their work. They are requested in documentary cases,” he defended.
The PSD deputy insists that this reaction by the government stems from “an opposition to compliance with the law” and a “profound disrespect” and “an affront to the powers of the sovereign body of the Assembly of the Republic”. the investigation meets today to “find the tools and mechanisms” to access the documents you requested.
On April 4, the very day of TAP’s CEO hearing, the PSD asked for the documents and opinions that gave “legal support” to the government’s decision to dismiss Christine Ourmières-Widener for just cause in order to find out whether it was the decision that “best protects the interests of Portuguese taxpayers”.
“The PSD wants to ensure that between the Friday of signing the report proposal [da IGF] and the Monday of homologation, if all these documents exist, all these opinions that, with unequivocal certainty, point to dismissal for just cause as the best solution to solve this problem and as the solution that best serves the interests of the Portuguese taxpayer protects”, Paulo Moniz then told journalists.
