Euthanasia. PSD repeats request for follow-up investigation to the Constitutional Court

The PSD leader reiterated this Friday that the party will ask for sequential inspection of the euthanasia law, if enacted by the president of the republic, forcing review by the Constitutional Court (TC).

“The text will be approved, ratified by the President of the Republic. If there is a promulgation and entry into force of this law, PSD deputies will not be able to do without their ability and ability to request successive inspection of this legislative instrument, in a context of freedom where everyone will conduct their own analysis and also study the subject legally,” said the president of the PSDhours before parliament confirmed the decree.

The request for successive inspection does not suspend the entry into force of the law, unlike the preventive inspection, but can stop it if the TC deems it unconstitutional.

The diploma on death with medical assistance, vetoed by the President of the Republic, was confirmed by a total of 129 votes in favour, forcing the head of state to issue it.

According to the constitution of the republic, despite a right of veto, the parliament can confirm the text with an absolute majority of the deputies in office, 116 out of 230, and in this case the president of the republic will approve the diploma within eight days of receipt .

Luís Montenegro defended holding a referendum before the adoption of the document and expressed “deep regret that the parliament and its majority, not only, but above all the majority formed by the Parliamentary Group of the Socialist Party, was not open to the endorsing the responsibility to take a step which, as the President of the Republic rightly said, is of great sensitivity with the contribution of the political will of the people”.

The PSD leader also criticized that the “legislative process itself was basically a zigzag”.

“The leader of the Socialist Party has this habit a lot, which is throwing stones at others who fall on his feet. If there is one party that has zigzagged, it is the Socialist Party, which has already passed three or four versions of the law and faced rulings from the Constitutional Court, which declared the legislative solution proposed by the Socialist Party unconstitutional.

Montenegro also complained about the “iron will to legislate hastily”, he assumes, “for the sake of certainty and legal certainty it is good that there is a ruling by the Constitutional Court on this issue”.
