The judicial police already have the mobile phone of the assistant acquitted by João Galamba, Frederico Pinheiro and according to the PJ source, it is expected that they can recover the messages from the device.
This expertise could be essential in proving whether someone has lied or attempted to boycott the work of the Parliamentary Commission of Inquiry (CPI), which, if it happens, constitutes a crime.
After the investigation is carried out, a certificate of the investigation carried out is sent to the parliament for the CPI.
In addition to this zeal, the Judiciary, the DN learned from judicial sources, will also investigate all incidents that have occurred at the Ministry of Infrastructure: the alleged situation of assaults and kidnappings, whether or not the laptop has been classified documents and whether these have been forwarded to third parties etc.
It is recalled that the former aide to the infrastructure minister agreed this Wednesday to hand over the agency’s mobile phone to the PJ, to try and recover deleted messages as part of an intervention he said was requested by the chief of cabinet .
The agreement was given by Frederico Pinheiro, in TAP’s parliamentary inquiry committee, after the suggestion of Chega, who understood that the mobile phone, “the elements of which have been erased, is a decisive element in determining the truth”.
“I think that given the centrality of the document [eletrónico] and the possibility that the PJ, through his computer center, recovers some of the messages, […] it would be decisive for establishing the truth” leave the mobile phone with the investigative committee or with the PJ with the signature of the CPI, suggested André Ventura.
Frederico Pinheiro recalled that the mobile phone is not his and that he is waiting for an appointment to deliver the equipment to the state.
“The mobile phone was formatted by me, not least because it contained classified information, which of course I immediately deleted from my mobile phone after I left the Ministry of Infrastructure,” said Frederico Pinheiro.
The president of the investigative commission, António Lacerda Sales, explained that for the commission to keep the mobile phone, the criminal police authorities must be notified to collect the equipment, unless the former deputy intended to give it to the police, under the signature of the Commission of Inquiry.
Frederico Pinheiro, after consulting his lawyer João Nabais, finally agreed to this suggestion. “It’s so defined,” Lacerda Sales replied.
At the end of Frederico Pinheiro’s hearing, which lasted more than five hours, the chairman of the committee said that, after a more detailed analysis and based on Article 13 of the legal regime for parliamentary investigations and the rights of deputies, the former deputy had the right to produce objects or documents that could serve as evidence.
At a rare moment in a committee of inquiry, a delivery note was read by Lacerda Sales, recording the make and model of the mobile phone, pointing out that the committee had asked the deponent to voluntarily hand over the equipment, followed by the signature of the same and the delivery of the material, photographed by several mobile phones of deputies and journalists present in the room.
The mobile phone was kept in a safe in parliament until it was handed over to the judicial police.
