Fernando Santos loses trial against Treasury for contract with the FPF

The Administrative Arbitration Center (CAAD) rejected Fernando Santos’ request regarding the fiscal framework of his contract with the Portuguese Football Federation (FPF), the coach and the FPF confirmed to Lusa on Monday in a statement.

Fernando Santos requested clarification on the tax regime applied to the contract signed by his company with the FPF, in the year 2014, on which IRC and IRS had been paid, with a view to the return of the amounts already paid as IRS of the years 2016 and 2017, which are around four million euros.

In a statement, the coach gives an account of the CAAD’s decision regarding the fiscal framework of this contractual relationship, noting that all income has been declared.

“During the sessions at the CAAD it was of course shown that my company already existed when I was coaching in Greece, so it is not fictitious nor was it created for the purpose of me becoming a national coach,” said Fernando. Santos, admitting himself relieved by the clarification known today: “The mere existence of this doubt – fortunately overcome – left me hurt and deeply offended. It would go against all the principles with which I have always guided and guided my life”.

The 67-year-old technician considers that “it was evident” that he did not try, nor the FPF, “to create a scheme through which information is withheld or the Tax Authority (TA) or any other authority is deceived.”

“My company (FEMACOSA) and I have fully and promptly declared all the payments made and the corresponding income obtained to AT. In view of the interpretation held by AT, the additional tax (IRS) required was paid immediately, so I do not and will never owe AT a penny,” the coach concluded.

The FPF reiterated its support for Fernando Santos on Monday, praising the coach’s conduct.

“Since he was invited to assume the position of national coach, Fernando Santos has always behaved irreproachably from an ethical, moral and sporting point of view. The existence of a single contract for the services of the entire national technical team was an option of the FPF, in order to avoid pressure in case there were casualties (such as those that had occurred with other coaches and their technical teams) “, explained a federal source.

Given this interpretation of the CAAD, both Fernando Santos and the FPF reserve the right to take “any legal action that may be justified.”
