Jenni Hermoso appeared on Tuesday at the headquarters of the Attorney General of Spain and personally formalized, before the Public Prosecution Service, a complaint about the non-consensual kiss that the president of the Royal Spanish Football Federation (RFEF), Luis Rubiales, had meanwhile suspended, gave her at the ordination ceremony of the Spanish women’s team as world champion.
The news is brought forth by the elDiario.esciting expert sources of the process.
Hermoso’s statement is an essential requirement for the prosecution to act against Rubiales, as the events took place abroad, in this case in Australia.
This investigative process was opened on August 28 by the Attorney General of the National Court, with lawyer Marta Durántez offering the player the opportunity to formalize a public complaint, granting her a 15-day deadline.
The Spanish public prosecutor recalls that Article 191 of the Penal Code establishes the obligation to file a “complaint from the injured party, its legal representative or a complaint from the Public Prosecutor’s Office” for crimes of aggression or sexual harassment.
When the prosecution decided to open the proceedings, Jenni Hermoso had not filed a complaint against Rubiales, but made it clear in a statement on her social networks that the kiss was not consensual and that she did not like it, given the gesture. “an aggression, an impulsive, sexist, misguided act and without any form of consent on my part”.
The Public Prosecution Service considers these statements to be “unambiguous”.
Following the events in Sydney, Rubiales was subject to numerous criticisms, with player Jenni Hermoso stating that she had not consented to the kiss, contrary to what the RFEF’s suspended president guarantees.
Rubiales said two weeks ago he would not be leaving the post, sparking a new spike in contention and extreme positions, with the squad’s players announcing they are unavailable to return to represent Spain, while the current leaders of the RFEF remain in the positions.
On August 26, FIFA announced the suspension of Rubiales for 90 days, and 11 members of the technical team of the coach, Jorge Vilda, submitted their resignations. For his part, the technician condemned the “inappropriate behavior” of the RFEF chairman.
