Dani Alves case. Judge sees “more than enough” evidence of violation

The Spanish judge in charge evaluating the accusation of rape by Brazilian player Daniel Alves of a 23-year-old girl in the bathroom of a nightclub in Barcelona, Spain, sees “more than enough” evidence that the crime was committed, according to the investigative report to which the Catalan newspaper “El Periódico” had access.

The statement is, for now, just a comment in the text by Marín, who is solely responsible for assessing whether the case should go to court. The attack still has no legal consequences for Daniel Alves. However, based on this text, Marín will decide whether or not the case should go to court.

The player has been detained in Barcelona for almost two weeks on charges of raping a woman. The Brazil international was detained while making statements about the case. Judge Anna Marín saw contradictions in the statements and accepted a request from the Spanish Public Prosecutor’s Office to take the player into custody without bail.

The Spanish judiciary reported last week that it had launched an investigation against the Brazil international, following a complaint from a woman who accuses him of sexually assaulting her in December.

The Supreme Court of Catalonia then, without disclosing the footballer’s identity at the time, indicated that an investigation had been opened into the alleged crime of sexual assault, following a woman’s complaint against a footballer.

A source close to the trial later told AFP news agency that the player was Dani Alves, and Catalan police said the complaint was filed on January 2.

According to the local press, the events took place on the night of December 30-31 at a club in Barcelona, but on January 5, the footballer told Spanish television channel Antena 3 that he had not attacked anyone and that he does not know the complainant.
