The so-called “Caso Paulinho” will affect the timing of the penalties and become a huge “mess”, according to the Disciplinary Board (CD) of the Portuguese Football Federation (FPF), which said today it could not guarantee that clubs enter the field to know the penalties of previous matches.

“The CD, which has so far ensured that all clubs enter the field with knowledge of the penalties associated with previous matches (holding several meetings per week for this and publishing several weekly cards), will not be able to, due to the understanding on deadlines imposed by the club and confirmed in court and subject to match calendars, ensure that this will continue to happen at all times,” the federation’s disciplinary body said in a statement.

According to the CD of the FPF, the new interpretation of the time limits applicable to the summary proceedings “may also prevent a timely decision on the appeal against the applied sanctions”.

The Lions appealed this penalty to the full FPF CD, for the visit to Rio Ave, for the 19th round of the I Liga, without preventing Paulinho from serving the second suspension.

Sporting subsequently appealed to the Court of Arbitration for Sport (TAD) together with an injunction granted by the Southern Administrative Central Court (TCAS) suspending the decision of the FPF CD, without, however, stating the merits. have reviewed the case, as disclosed in this body of appeal on its official website on the internet, without identifying the persons concerned.

“Although the CD considers that the right of defense and hearing of a player whose club is notified at 09:37 on January 30, 2023 until 12:00 the following day (that is more than 26 hours later, a period longer than one day ) to be able to say in writing, if he so wishes, what can be offered about the facts present in the minutes relating to the game in which he intervened, saying or requiring nothing during that period, the presiding Judge of TCAS, signed another agreement as a precaution,” adds the federal body.

The CD of the FPF recalls that in July 2020, when the mandate began, sports agents were punished in summary proceedings without knowledge of the match reports and without the right of defense and that it was on their initiative that “the new procedure for sanctioning in summary proceedings, which guarantees access to reports and the defense of what is reported in them”.

The aim was to “reconcile respect for the right of defense with speed”, so that in professional leagues the penalties for the next matchday would be known: “In the current sports season alone there were hundreds of interim sanctions in the Pro section and the CD always made sure they were known to sports agents before the next game, despite the growing number of games and their spread over several days of the season. week.”

Now that the court ruling is known, the CD of the FPF explains that it is necessary to ensure equality. “This new interpretation, resulting from a court ruling just put forward by a club that intervened in the regulatory definition of the procedure for summary proceedings (by self-regulation), imposes, for reasons of equality, that from now on the same period is guaranteed for all sports agents.”, according to the disciplinary board’s communique.
