Does residing in Dubai really protect influencers from French law?

An alternative solution to escape French taxes, a move to the Arab emirate, however, does not guarantee influencers peace of mind about their business practices.

Over time, it has become the miracle solution for a good number of influencers to obtain a more advantageous tax regime and a better “quality of life”: moving to Dubai, in the United Arab Emirates.

In fact, the city has become a land of refuge for a large part of French influencers for several years. Nabilla, Jazz, Dylan Thiry and recently Poupette Kenza. Indeed, the influential mother of a family is moving to the emirate and she seems to be delighted with it, especially in her stories where she mentions a possible sanction of 50,000 euros from the DGCCRF against her.

Same functions as in France

Except that going to Dubai will not end the obligations of the influencer, who could continue to be subject to the DGCCRF in case of bad practices. Since the promulgation of the influencers law last June, all people in the world of influencers, and therefore their commercial influencer activity, aimed at a French audience, are subject to French law.

The law thus specifies that influencers cannot promote prohibited products, such as tobacco, alcohol, laser hair removal services or dental whitening, the latter subject to the sanction of the DGCCRF against Doll Kenza. And this even while she is doing her stories from Dubai. Because as the deputy Stéphane Vojetta reminds us in a tweet, at the initiative of the influencers law, the law applies worldwide.

The new influencers from Dubai should also not forget to have a connection in France with the mandatory appointment of a legal representative in the European Union as well as the subscription of civil insurance to compensate potential victims.

In case of non-compliance with French law, influencers risk above all what constitutes their livelihood: their account on social networks. The Ministry of Economy thus specifies “that an influencer based abroad can have their content blocked as soon as they do not respect French legislation, in particular regarding the commercial nature of their publications, or promote products or services whose promotion is regulated or prohibited”. “.

The most serious cases may be especially subject to criminal sanctions. The French and Dubai police cooperate and can, in extreme situations, extradite people who do not comply with their legal obligations.

As indicated in the extradition agreement signed in 2007 between the two countries, “the two States undertake to reciprocally surrender, in accordance with the provisions of this Agreement, any person who, being in the territory of one of both States, is being prosecuted for a crime or sought in order to serve a custodial sentence imposed by the judicial authorities of the other State as a consequence of a crime”.

Moving to Dubai is therefore not a sign of absolute tranquility and freedom for influencers who, having forged their entire community in France, have no choice but to keep in touch with it, be it with stories but also with laws.
