This was one of the measures proposed by the Minister of National Education, Gabriel Attal, on September 22: the confiscation of the mobile phone of the child responsible for serious cyberbullying. Therefore, this measure was included in the inter-ministerial plan to combat bullying, presented this Wednesday by Prime Minister Elisabeth Borne.
In reality, this judicial confiscation is not new, it already exists in the law, but for the government it is about encouraging justice to maintain this pre-sentence measure, which is used too little.
In practice, the idea is to be able to immediately seize the student’s phone to search for evidence and avoid an immediate repetition.
The “cost” of the telephone
“It is a relatively young law, but very ambitious that will undoubtedly produce effects to punish the authors,” explained Jean-Noël Barrot, head of Digital.
Still, it’s pretty easy to just borrow another phone, tablet, or computer to continue stalking.
“And if we’re pre-sentence, that means this phone can be returned. Is it worth it? Are we going to reinvest in a new phone?” she emphasizes again.
