Since January 1, 2024, the state of Illinois, located in the northeastern United States, has adopted no less than 320 new laws, one of which affects videographers and influencers who live from their vehicle.
Along with bans on smoking and vaping, there is now the impossibility of driving live on streaming platforms such as YouTube, TikTok or Twitch. However, there are exceptions if hands-free or voice control devices are offered, in particular to facilitate receiving or stopping live broadcasts with a single button.
Illinois wants to avoid risky behavior
It is clear that legislators want to hold influencers responsible, but also young users who participate in this type of content. If Illinois legislates on this issue it is because, despite a clear prohibition of this practice by the platforms, particularly in their statutes, the police would not necessarily be able to pursue potential violators.
On the Twitch side, for example, the platform reserves the right to restrict the actions of an Internet user if they drive while broadcasting live. It is certainly possible to be in the car, but the streamer should not be the one driving.
Four years ago, Twitch banned several accounts on the grounds that their behavior was dangerous on the road, setting a precedent. TikTok, a social network popular among young people, has also increased its penalties to prevent its creators from driving while broadcasting live.
