The hearing to decide whether or not to block five porn sites opened on Tuesday, September 6. This issue is at the heart of the trial.
The decision to invite the parties to negotiate will be formally taken on Thursday, September 8, but the choice of economist Bruno Deffains as mediator has already been considered.
A registered QPC
The Cypriot company MG Freesites, publisher of the Pornhub platform, one of the five sites subject to this procedure, has for its part presented a priority question of constitutionality (QPC) that questions the legitimacy of Arcom to act.
The court will decide on October 4 whether or not to send this QPC to the Court of Cassation. If not, a new civil hearing would be organized to examine the merits of the case. A similar QPC was proposed in a joint administrative proceeding.
During the discussions, the lawyers representing Pornhub, Tukif, XHamster, Xvideos, Xnxx, the subject of a formal notification by Arcom in December 2021 and which are among the most visited sites in France, tried to demonstrate their goodwill.
