An Argentine will receive $ 12,500 in Google’s compensation after being photographed on the simplest device in the inner courtyard of his house next to the Street View navigation service, according to a judicial decision presented on Thursday by the local press.
The plaintiff, a member of the police, felt humiliated after the transmission in local television news and on the social networks of this naked photo, taken in 2017 by the cartography of the giant of American technology.
The face, generally blurred by Google Street View, was not visible in the photo because the man appeared from behind, but the identification of his home made it easily recognizable in Bragado, a small city located 210 km from Buenos Aires, which made it the goal of the mockery of neighbors and colleagues, according to the composu.
According to the American Media CBS, the number and name of his street had been revealed by Argentine television that had assumed history, and had been shared on social networks.
Google defended himself by saying that the wall of the house was too low and that the plaintiff had not “preserved his intimacy.”
In the first instance last year, a judge said that the man was responsible for the situation because “he was walking in inappropriate conditions in the garden of his house.”
However, in the appeal, justice has given the plaintiff right, ruling that the wall, 2 meters high, was high enough, and that the company had demonstrated “intrusion” in the plaintiff’s private sphere, “undermining its dignity.”
The National Chamber of Civil Calls of Buenos Aires condemned Google Argentina and Google Inc. to pay the plaintiff 16 million pesos, or almost 11,000 euros, such as repairs for damage to dignity.
The Court has absolved the telecommunications company Cablevision SA and the censorship information site of El, coacusado in this case, of any responsibility in the dissemination of the image, believing that their actions had helped highlight Google’s error.
According to CBS, Google agreed to pay $ 13 million in 2019 for the collection of private information as part of Street View.
In 2010, according to CBS, Google had paid a dollar in damage to a couple who had sued him for violation of the property taking photos of his house in the Pittsburgh region.
