Sensitive data: the Government does not rule out binding measures for companies

During the inauguration of the new OVH Cloud data center, Bruno Le Maire announced possible measures to strengthen the security of digital personal data.

The government does not rule out forcing French companies to use cloud services (online storage system) to escape extraterritorial laws for their sensitive data, the Minister of the Economy and Finance, Bruno Le Maire, announced on Monday, September 12.

Initially, this recruitment will be done on a “voluntary” basis, explained the minister.

The market for cloud services (the storage of data on servers external to the company that retrieves it, editor’s note) is dominated by large US players such as AWS (Amazon), Microsoft or Google.

The government wants to put pressure on companies and administrations to go to the cloud, but it is concerned about the extraterritorial laws of the United States, which allow the American authorities to ask their companies in the cloud to provide their clients’ data, regardless of what place they are the planet.

France has defined a security standard, called SecNumCloud, which, in addition to technical security criteria, requires that the cloud service operator be European to escape these extraterritorial laws.

Few companies tagged

At the moment, very few services or companies have managed to earn this demanding label: the government lists 7 services from 5 different French companies, including OVHCloud.

Bruno Le Maire clarified that the government will indicate “in the coming weeks, through circulars”, what it understands by “sensitive data”.

The question arises in particular for industrial data, which is not protected by legislation as personal data is.

“I do not see in the name of what or who we would accept that the American justice seizes essential data for our sovereignty or our independence,” the minister stressed.
