Cyberspace security agency warns of 5G equipment from “high-risk” countries

The Security Assessment Commission, within the scope of the Higher Cyberspace Security Council, considered the use of equipment from countries outside the EU, NATO or OECD to be “high risk” for the security of 5G networks and services. .

According to a determination published on the website of the National Security Office, the entity warns of the “high risk to the security of national networks and services derived from the implementation and use of 5G technology, the use of equipment and services that come from from a vendor or vendor that meets” one or more criteria.

The first mentioned is that “the legal system of the country in which it is domiciled or to which, in any other relevant way, it is bound, allows the Government to exercise control, interference or pressure over its activities that are carried out in third countries”.

The second criterion is that the supplier “is domiciled or, in any other relevant way, linked to a country that is not a Member State of the European Union (EU), the North Atlantic Treaty Organization (NATO) or the Organization for the Economic Cooperation and Development (OECD)”.

The organization also warns of countries that do not have “legislation or diplomatic agreements with Portugal, nor with the EU in terms of data protection, nor cybersecurity, nor protection of intellectual property.”

“High risk”, he also considered, are countries recognized by Portugal, the EU or NATO (NATO) as responsible “for actions hostile to the national security and defense of Portugal or its allies, namely acts of espionage or sabotage”.

Finally, he warned the countries that “repeatedly practice actions contrary to international law and, in particular, the Charter of the United Nations Organization and respective solutions aimed at promoting responsible behavior in an open, safe and protected cyberspace”, that They have a “lack of transparency”. in its corporate governance” and whose production and supply chains depend on one of these countries.

The entity carried out a security assessment, in accordance with section 3 of article 62 of the Electronic Communications Law, approved by Law 16/2022, of August 16, on the use of public electronic communications equipment of 5th generation of telecommunications (5G) in Portugal, which gave rise to these conclusions.
