“A white letter to expel them”: American lawyers denounce new rules aimed at foreign students

Foreign students attacked by the Trump administration denounce the entry into force of new rules that allow them to be expelled more easily.

The lawyers denounce the measures taken by the Administration to more easily expel certain foreign students, in particular the young activists who participated in the demonstrations against the War in Gaza, reports the Associated press agency this Wednesday, April 30.

Several of them have been arrested and attacked by expulsion procedures by US authorities in recent months, but in many cases, justice has considered that these procedures were not part of a legal framework. The Administration had announced at the end of April that it would soon publish new directives to facilitate the cancellation of the student’s legal status and, therefore, their expulsion.

According to AP, which quotes lawyers for expulsion students, a document from the Immigration and Customs Service (ICE) presented this Monday, April 28 in the context of legal procedures indicates that the valid reasons to cancel the legal status of a student now include the revocation of their visa.

“This gives them a white letter to revoke a visa and expel these students, even if they have not done anything wrong,” is Alarm Brad Banias, lawyer for an interested person, with the US agency.

Previously, if a student’s visa were fired, he could generally stay in the United States to finish his studies. On the other hand, if he left the country, he simply could not return to that.

Secretary of State Marco Rubio said the administration canceled certain visas due to the participation of students in pro-palestinian demonstrations that, according to him, damage the interests of the foreign policy of the United States. But he recognized in March that certain procedures were more “linked to a possible criminal activity.”

However, many students whose visa has been dismissed or whose legal status has been canceled have declared that they only have crimes under their criminal record, such as traffic control.

Since the beginning of his mandate, Donald Trump has taken it hard in the American universities, Columbia and Harvard in mind, accusing them of having left the “anti -Semitism” thriving in their campus during the mobilization of the students against the war in Gaza directed by Israel after the attack against Hamas on October 7, 2023.
