An American Court of Appeals confirmed this first instance decision on Thursday, September 4, ordering the Trump administration to resume passport issuance with the genus “X” or a different gender of birth for transgender or non -binary people.
Donald Trump signed on January 20, his opening day, a decree according to which only two genders -meculine and female would now be recognized in the United States.
The State Department had stopped in the process of delivering passports with the genus “X” or a different gender of the type of birth of the holders, in the application of this decree. But an American judge had ordered the administration in June to resume its delivery.
“Several immediate and irreparable damages”
An appeal court on Thursday rejected the government’s request to suspend this decision, confirming the conclusion of the Court of First Instance according to which affected persons will submit to “several immediate and irreparable damages” due to Donald Trump’s decree.
The first American passport with the genre “X” had been issued in October 2021 by the State Department, which had specified that the box “X” was reserved for “non -binary, intersex” people “and, in general, those who are not recognized in the gender criteria offered until then.
