Arrest order against Benjamin Netanyahu: appeal presented by Israel rejected by the International Criminal Court

The International Criminal Court rejected this request on July 16. He assures that there is “no legal basis” to proceed with this cancellation.

The International Criminal Court (ICC) rejected this Friday, October 17, 2025, the appeal request presented by Israel against a previous decision that confirmed the arrest warrants issued against Israeli Prime Minister Benjamin Netanyahu and former Defense Minister Yoav Gallant.

In a decision that made international headlines, the ICC ruled in November that there were “reasonable grounds” to believe that MM. Netanyahu and Gallant were “criminally responsible” for alleged war crimes and crimes against humanity related to the war in Gaza.

“Without legal basis”

These arrest warrants sparked outrage in Israel and the United States, which have since imposed sanctions on senior ICC officials. Benjamin Netanyahu called the decision “anti-Semitic” and US President Joe Biden called it “scandalous.”

In May, Israel asked the ICC to reject the orders while it considers another challenge to determine whether it has jurisdiction in the case.

The Court rejected this request on July 16, finding that there was “no legal basis” to quash the arrest warrants until the question of jurisdiction had been decided.

A week later, Israel asked for permission to appeal that decision, but the judges ruled Friday that “the issue, as formulated by Israel, is not subject to appeal.”

“Therefore, the House rejects the request,” the ICC said in a complex thirteen-page decision.
