Ivo Rosa has been given permission to try a Rwandan businessman accused of genocide

The Supreme Court of the Judiciary (CSM) authorized Judge Ivo Rosa to join the court in The Hague (Netherlands) in 1994 trying Félicien Kabuga, a businessman accused of genocide and crimes against humanity in Rwanda.

According to information provided by the CSM on Friday, the judge sent a request this Monday informing him of his appointment to the trial, requesting permission to join the panel of the International Criminal Court, which was granted.

“Given the urgency of this request, the request was granted by the Vice-President of the CSM, Counsel Judge José Sousa Lameira, who sent it to the Plenary Council for ratification”the CSM clarified to Lusa, noting that the magistrate explained that this appointment “does not interfere in any way with the conclusion of the instructional decision with respect to the trial assigned to him,” in allusion to the “O Negativo” trial assigned to the corridor is at the Central Court Criminal Court.

Information on the appointment of the judge for this trial was provided this Friday by SIC Notícias. It involves the death of one of the judges who served on the panel for the trial of Félicien Kabuga, with the presiding judge proceeding with the immediate replacement to continue the trial.

The appointment of Ivo Rosa comes at a time when the magistrate is still awaiting the decision of a disciplinary procedure initiated by the CSM.

On the other hand, his promotion to the Lisbon Court of Appeal is still suspended and he has now applied for the position of European Public Prosecutor’s Office.

Ivo Rosa has been a judge at the International Criminal Court, based in The Hague, since 2011, when he was elected by the United Nations (UN) General Assembly, and was reappointed to this body in 2020, after informing the CSM through a letter from the Secretary General of the United Nations, António Guterres.

Félicien Kabuga, currently 89 years old, is accused of being one of the financiers of the 1994 genocide in Rwanda, which left more than 800,000 dead. He was on the run for about 25 years until he was arrested on the outskirts of Paris in May 2020, and the trial began in September 2022.
