The Italian Senate refuses to recognize the children of homosexual couples as proposed by the EU

The Italian Senate today rejected the “European Certificate of Paternity” proposed by the European Commission, so that all countries of the European Union automatically recognize paternity established and legal in another Member State, including LGBTQ families.

With 11 votes against and seven in favour, the Brussels proposal was rejected by the European Policies Committee of the Italian Senate, whose position will now go to the European Council, along with the resolutions of the other state parliaments.

The rejection was supported by the government’s right-wing coalition, led by far-right Giorgia Meloni, while all opposition parties voted in favor of the EU proposal.

According to the resolution, “some of the provisions contained”, such as the obligation to recognize the European certificate, “do not respect the principles of subsidiarity and proportionality”, so that, if approved, “would mean an invasion of European law on national law”. .

In addition, the senators against the certificate argued that it could be a problematic issue in the case of surrogate pregnancy, legal in some EU countries but prohibited in Italy.

However, for the Italian opposition, led by the Social Democrats of the Democratic Party (PD), this rejection represents an obstacle to the rights of minors, especially same-sex couples.

“The majority opinion puts Italy on the side of Poland and Hungary in restricting the perimeter of rights. This regulation proposed by the EU has not affected Italian laws and regulations in any way,” said Senate PD spokeswoman Simona Malpezzi .

The proposal, added Malpezzi, only guarantees that “children with the status of minors in a certain EU country can have the same status as children in the European country where they travel with their parents, always prioritizing the priority rights of the minors”.

Also today, the government delegation in Milan, in northern Italy, recommended to the city’s mayor, Giuseppe Sala, to stop registering children born abroad as children of same-sex couples. In July 2022, the mayor began to authorize the registration of children of homosexual couples, based on a legal vacuum, which allowed some 300 families to register their children in the civil registry as their own and not as adopted.
