United States: What legal consequences for Donald Trump after his impeachment?

The former US president, still a candidate for the White House, is federally and criminally accused. Although he will campaign in the coming months, several appointments with justice are scheduled.

Donald Trump’s legal troubles are far from over. The Republican billionaire is charged in two separate cases, one in federal court and the other in criminal court. The former tenant of the White House, presidential candidate, pleads not guilty and will find himself in court again in the coming months, after his historic appearance on Tuesday.

• A first trial before the end of the year?

In the case of the classified White House documents, Donald Trump had to appear before a federal court in Miami. This paves the way for a potentially very damaging trial for his campaign for the 2024 US presidential election, without preventing him from running.

A trial that could be arranged in the coming months, says ABC News. Because the federal courts in South Florida, where Donald Trump will therefore be tried, have a reputation for “rockets”: going fast with speedy trials. A federal judge notified him of the 37 charges against the former US president, who pleaded not guilty, but no date has been announced.

• The second in March 2024

Regarding the criminal accusation, which is related to three cases that occurred before his election to the White House in 2016, Judge Juan Merchan set March 25, 2024 as the start of the trial. Until then, Donald Trump will not be able to communicate certain elements of the file on social networks.

The former White House tenant’s defense has until August 8 to file appeals to challenge the case and drop the case. But the charges are unlikely to be dropped. Juan Merchan will decide at the next hearing where Donald Trump is summoned to participate: December 4, 2023.

• What strategy for the billionaire?

There are two options available for Donald Trump’s team. The first would be to “speed things up,” CNN explained in April. The goal: to avoid being embroiled in media lawsuits when the Republican Party’s presidential primaries begin. Its kickoff will be given on February 4, 2024, with the Iowa caucus.

Especially since the billionaire probably isn’t done with legal trouble. A Georgia prosecutor is due to announce the outcome of her investigation into her pressure to try to move the 2020 presidential election to September. A special prosecutor is also investigating her role in the assault on the Capitol on January 6, 2021.

The defense of the former tenant of the White House can also present a series of motions to lengthen the different procedures. With Axios, Tim Parlatore, a former lawyer for Donald Trump, even foresees a series of appeals, once the trials are over.

“If there’s one case you’ve always known would go all the way to the Supreme Court, this is it,” he says of the case of the confidential White House documents.
