Thousands of taxpayers without income in 2021, but who nevertheless filed the IRS return, are excluded from the aid of 125 euros to be granted by the Tax Authorities (AT), as part of the package of measures taken by the government to help families the cost of high inflation. These households will also not be entitled to a check through Social Security, as they are not registered with the employment office and are not entitled to social benefits.

The Ministry of Finance has not responded to Dinheiro Vivo’s questions about the household universe negatively affected by this criterion. However, according to the most recent statistics from the Tax Authorities, which refer to 2020, there were more than 736 thousand taxpayers in the lowest income bracket, ie between zero and five thousand euros gross on an annual basis, so it can be inferred that thousands have the IRS tax return. filed without any form of income.

The tax authorities’ decision to exclude taxpayers without declared income from support in 2021 completely surprised thousands of families when they consulted the Finance Portal to determine whether or not they were eligible to pay the check. “The legislative act that creates the support and the government statements about this subsidy were not clear,” criticizes Marta Canas, a tax law specialist at Deco (Portuguese Association for Consumer Protection). To Dinheiro Vivo, the tax expert emphasizes that “the diploma provides for the granting of support to those who have declared in the IRS a gross income of up to 37,800 euros per year or 2,700 gross euros per month, without clarifying whether a person without income is entitled has or not”.

In this situation, and according to the cases that reached Dinheiro Vivo, there are mainly housewives who have opted for joint taxation with their husbands. In other words, “they have filed the income tax return and are therefore also subject to tax”, explains Dinheiro Vivo, tax expert João Espanha, from the law firm Spain&Associados.
